Terms of service

These terms are between you and W.BREWIN AND COMPANY LIMITED, which operates Oddpair at wbrewin.shop. The company’s registered particulars are published at legal information.

Using the service means accepting these terms. If you do not accept them, do not use it.

Nothing in these terms affects your statutory rights. Where a clause here and a right given to you by law point in different directions, the law wins and the clause has no effect to that extent.

You upload one or more photographs of unpaired socks laid flat. Each sock is read individually — main colour, accent colours, pattern, length, cuff width, knit weight. Your browser then works out which of them can be grouped so the grouping reads as deliberate, which combinations are close but blocked, and which have nothing in the pile to relate to. Each group is returned with a written reason.

The service does not, and is not intended to:

• give advice on clothing, styling or appearance;
• judge how anything looks on a person;
• accept photographs of anyone wearing anything, or produce images of people;
• recommend, rank or link to any brand, product or shop;
• advise on replacing, disposing of, donating, selling or exchanging anything.

Features may be added, changed or withdrawn. Where a change materially reduces what a paid plan provides, you will be told before it takes effect and may cancel and receive a refund of the unused part of the period.

• You must be at least 13. Between 13 and 17 you need a parent or guardian’s consent, and they are responsible for the account.
• One account per person. Accounts are not to be shared, sold or transferred.
• Keep your password to yourself and tell us promptly if you think someone else has it.
• The details you give must be accurate and kept up to date.

Your photographs remain yours. You keep every right in them. You grant the company a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit and process them strictly for the purpose of producing your pairing plan and keeping the service secure. That licence ends when you delete the photograph, subject only to the short retention described in the privacy policy.

Your photographs are not used to train any model, ours or anyone else’s.

The pairing plans produced from your photographs are yours to use as you wish, including commercially.

You confirm that you own or are entitled to upload what you upload, and that it contains no identifiable person.

The acceptable use policy forms part of these terms. In short: nothing unlawful, nothing involving other people’s images, and no attempt to get round the allowances, scrape the service or resell access to it.

There is a free plan and two paid plans. All prices are shown in USD and include VAT at 20%. The price you see at checkout is the price charged.

Each plan carries a monthly allowance, expressed in credits. Reading one sock costs one credit, a chat message costs one, and producing a pairing plan image with its near-miss sheet costs five.

Credits are a unit of service usage. They are not money, not stored value, not redeemable for cash, and not transferable. They have no existence outside your account and no value outside the service.

• An allowance resets at the start of each billing period.
• Unused allowance does not carry forward.
• There are no credit packs, no top-ups and no stored balance of any kind.
• If you run out before the period ends, the only route is to move to a larger plan.

Prices may change. An existing subscription keeps its price for the period already paid for, and you will be told at least 30 days before a change affects a renewal, in time to cancel.

Paid plans are billed in advance, monthly or annually as you choose, and renew automatically until cancelled. Before you pay, a single screen sets out the amount, the billing period, the date of the next charge and how to cancel; nothing is charged until you have seen it.

Card details are entered on a page operated by a payment processor certified to the PCI DSS. Card numbers do not reach this service.

Before each renewal you are sent a separate reminder email, which contains only the subscription details and how to cancel and is never combined with marketing. Annual subscriptions receive one such reminder each year.

If a payment fails, access to paid features pauses while we retry. Nothing is charged twice and no fee is added for a failed payment.

You can cancel at any time from the billing page, in the same number of steps it took to subscribe. There is no telephone call to make, no email to send and no retention offer to sit through. Access continues to the end of the period you have paid for.

Your statutory cancellation rights, the two confirmations taken at checkout, the fresh cancellation period given after each renewal and the model cancellation form are all set out in full on the cancellation and refunds page, which forms part of these terms.

Digital content and digital services supplied to a consumer must be of satisfactory quality, fit for any particular purpose made known to us, and as described. Those obligations apply here in full and are not excluded or limited by anything in these terms.

If the service does not meet them, you are entitled to have it repaired or replaced, and where that is not possible or not done in a reasonable time, to a price reduction. Tell us at support@wbrewin.shop and we will put it right.

Separately, the service reads photographs and applies rules to what it reads. What it can and cannot know is described on the notice about the model. That notice describes the limits of the output; it does not remove any right you have.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited — including a consumer’s rights in respect of digital content and digital services.

Subject to that, the company is not liable for loss that was not reasonably foreseeable when this agreement was made, and its total liability arising out of the service in any twelve-month period is limited to the amount you paid in that period.

The service is supplied for personal use. It is not supplied for business use, and liability for business losses — lost profit, lost business, business interruption — is excluded.

You may close your account at any time from the account page.

The company may suspend or close an account that breaches these terms or the acceptable use policy. Except where the breach is serious enough to make immediate action necessary, you will be told what the problem is and given a reasonable opportunity to put it right. Where an account is closed for a reason that is not your fault, the unused part of any period paid for is refunded.

These terms are governed by English law. As a consumer you may bring proceedings in the courts of the part of the United Kingdom in which you live, and you keep the benefit of any mandatory consumer protection of the country in which you are habitually resident.

The company does not belong to any alternative dispute resolution scheme. Please raise a complaint with us first at support@wbrewin.shop; if that does not settle it, nothing prevents you from going to court.
